In some Missouri cases it is necessary for the appointment of a Guardian ad Litem (GAL) to protect the best interests of minor children involved in domestic matters. A GAL is an attorney appointed by the Court when allegations of abuse or neglect are made in divorce, paternity, and custody modification cases.
The role of a GAL is to conduct an investigation into the case. In doing so the GAL can meet with the parties and the child(ren) involved separately. The GAL has the ability to collect relevant information via releases to the child’s school records, medical records or mental health records. Upon the conclusion of the GAL’s investigation, the GAL will present a parenting plan to the Court regarding custody, visitation and support of the minor child(ren).
A GAL serves in a domestic matter until the case is concluded by written agreement or there is a hearing and determination by the Court. It is important for all parties involved to include the GAL in all matters involving the minor child(ren) until the conclusion of the case.
